Personal data collected in the course of operating this website (see Server Log Files) is stored and processed on this provider's servers. A data processing agreement pursuant to Art. 28 GDPR is in place with the hosting provider.
The website provider automatically collects and stores information in server log files, which your browser automatically transmits to us. These are: browser type and version, operating system used, referrer URL, hostname of the accessing computer, time of server request, IP address.
This website uses a technically necessary session cookie (PHP session) to remember, for example, the selected language and contact form status messages between page loads. It is not used for analytics or advertising and is not shared with third parties. Legal basis is Art. 6(1)(f) GDPR (legitimate interest in a functioning website). The shop area additionally uses a session cookie for admin login.
If you send us inquiries via contact form, your details from the inquiry form including the contact data you provided will be stored by us for the purpose of processing the inquiry and in case of follow-up questions.
If you submit a request about Simple Locale via our support form, we store your email address as well as the subject and message text of the resulting ticket and any follow-up messages, in order to process your request. To handle multilingual requests, the message text may be machine-translated automatically - primarily via the Google Cloud Translation API (using our own API key, not yours), falling back to the free MyMemory service (see Section 5 for how MyMemory processes data). Legal basis is the processing of your request (Art. 6(1)(b) resp. (f) GDPR).
The following applies in addition when purchasing, activating, and using the "Simple Locale for IP-Symcon" software.
A license is purchased through our shop, with payment processed via Stripe - see Section 6 (Shop and Payment Processing) for details.
When you activate a purchased license in the software, it sends us, once, a cryptographic hash of the license key, an identifier of your IP-Symcon installation (technically read via the IP-Symcon function IPS_GetLicensee() - typically the email address registered for your installation), and the time of activation. The connection to our server is encrypted throughout (HTTPS). Important: this identifier comes from your own, local IP-Symcon installation and identifies which installation the license was activated on - we do not receive it from the Symcon company itself. Its sole purpose is assigning the license to an installation and detecting an unreported transfer or the simultaneous use of the same license key in several installations (the same key appearing with multiple different identifiers). Transferring a license to another person is permitted; it merely has to be reported to us so that we can reassign the key to the new holder. This data is not used for marketing and is not sold or passed on to third parties. Legal basis is our legitimate interest in enforcing our license terms (Art. 6(1)(f) GDPR). See Section 7 for retention. In response to the activation, our server transmits the tile designs belonging to the purchased edition (icons and HTML templates) to your installation, so that a special edition is displayed accordingly; a later fetch updates them. This is a download to you: no further data is collected from you in the process. The package is signed, stored locally in your installation and not transmitted again with every check.
The software additionally checks online once a day whether the entered license is still valid - the same data as at activation (hash, installation identifier, timestamp) is sent again. We respond with the current status (valid/blocked/revoked) and, where applicable, an updated expiry date. If the installation is offline, the check is simply skipped without penalty - a network error never results in a false block ("fail open"). This check also runs over an encrypted connection (HTTPS).
The actual translation feature of Simple Locale runs entirely on your own IP-Symcon installation. The object names and texts of your visualization that get translated are never transmitted to or stored by us (Synergetix) - see Section 5 (Translation Providers). We also never receive credentials to your IP-Symcon installation or any other content of your visualization.
Simple Locale translates the object names and texts of your visualization by sending requests directly from your IP-Symcon installation to one or more translation services - without going through any Synergetix server. We never receive the content being translated and are not involved in this processing as a data controller; the controller for processing at these services is each respective provider. Your data stays between your IP-Symcon installation and the translation provider you choose.
Without your own API key, Simple Locale uses the free MyMemory service (mymemory.translated.net, operated by Translated S.r.l., Rome, Italy) by default. The text to be translated is sent directly from your installation to MyMemory; you may optionally provide a contact email address to receive a higher daily quota - this is then also transmitted directly to MyMemory. Under MyMemory's terms of use, submitted text segments are stored on a long-term basis and, unless explicitly marked private, may become part of the public translation database that other users and partners can access; the module does not mark requests as private. If you enter your own Google Cloud API key, your installation sends the text to be translated directly to the Google Cloud Translation API, using only that key of yours. According to Google's current information, submitted content is used solely to provide the translation service, held only briefly for processing, and not used to train Google's translation models. Note that the interface used has a global endpoint - Google therefore cannot guarantee that processing takes place exclusively within a specific region (e.g. the EU). Alternatively, you can enter your own DeepL API key - here too, the text to be translated is sent directly from your installation to DeepL (DeepL SE, Cologne, Germany), using your own key. More information: deepl.com/privacy.
When you place an order, we collect and store your name, billing address, email address, VAT ID (if applicable), the product purchased, and the price paid. This data is processed to fulfil the contract (Art. 6(1)(b) GDPR) and to issue legally required invoices (Art. 6(1)(c) GDPR in conjunction with § 14 German VAT Act) - see Section 7 for retention.
Payments are processed by the payment provider Stripe (Stripe Payments Europe, Ltd., Ireland). We transmit to Stripe the data required to process payment (including name, email address, invoice amount, order reference); you enter your actual payment data (e.g. card details) directly with Stripe - we do not receive or store complete payment data ourselves. Stripe processes this data as an independent controller for its own purposes as well (e.g. fraud prevention); see Stripe's own privacy policy for details. Legal basis for our transmission is Art. 6(1)(b) GDPR (contract fulfilment). More information: stripe.com/privacy.
We retain order and invoice data for 10 years from the end of the respective calendar year, as required under German commercial and tax law (§ 147 AO, § 257 HGB). License activation records (see Section 4) are retained for the duration of the license and for a reasonable period thereafter, to protect against license abuse and to establish or defend legal claims. Support tickets are retained for the duration of the business relationship and for a reasonable period thereafter for documentation purposes. Contact form data is deleted once your inquiry has been fully processed, unless a statutory retention obligation applies.
Subject to applicable legal requirements, you have the right at any time to free information about your stored personal data, its origin and recipients, and the purpose of the processing, as well as a right to rectification or erasure of this data (Art. 15-17 GDPR). You also have a right to restriction of processing (Art. 18 GDPR), a right to data portability (Art. 20 GDPR), and - where processing is based on our legitimate interest - a right to object (Art. 21 GDPR). Please use the contact details given in Section 1 to exercise these rights.
In case of a data protection violation, you have the right to lodge a complaint with the competent supervisory authority. The authority responsible for our registered business address is the Landesbeauftragte für den Datenschutz und für das Recht auf Akteneinsicht Brandenburg (LDA Brandenburg), lda.brandenburg.de. You may alternatively contact the supervisory authority of your habitual residence.
We update this privacy policy whenever changes to our data processing make this necessary, or to align it with changed legal requirements. The version published on this page at the time of your visit applies.
